Conditions of Prize

1. Information on how to enter the “Patties – Win a VIP Event Experience Promotion” (the Promotion); claim any prize, or the prize, forms part of these terms and conditions (the Terms & Conditions). Participating in
the Promotion by any means (including but not limited to entering or attempting to enter, claiming or attempting to claim any prize) is deemed acceptance of the Terms & Conditions.

2. The promoter is Patties Foods Pty Ltd (ABN 62 007 157 182) of Level 2, 1 Joseph Ave, Chifley Business Park, Melbourne, Victoria 3194 (Promoter). The Promotion is run in conjunction with Bidfood Australia Limited (ABN 33 000 228 231), Building A, 10 – 14 McPherson Street, Banksmeadow, NSW 2019 (Bidfood).

3. Entry is open to Australian business customers who are involved in the end-user food service industry (i.e. a business or organisation that serves prepared or cooked food to the general public either at a restaurant, café, caterer, club, pub, hospital or education facility, or business or organisations of a similar kind), excluding the Promoter’s or Bidfood’s resellers, wholesalers, suppliers, contract customers, contract caterers or operators with exclusive supply agreements, government and statutory bodies, and agencies associated with this Promotion (entrant). Individuals (i.e., authorised representatives) entering on behalf of the entrant must be Australian residents aged 18 years or over.

Directors, management and employees (and their immediate family members) of the Promoter, Bidfood and the related companies and agencies associated with the conduct of the Promotion are ineligible. “Immediate family members” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

Promotion commences at 12:01 am AEDT on 1/02/26 and closes at 11:59 pm AEST on 31/03/26 (Promotional Period). All times and dates specified throughout these Terms and Conditions will be either AEST or AEDT, depending on when applicable in New South Wales.

6. To enter, an entrant (or authorised representative on behalf of the entrant) must, during the Promotional Period:
(b) visit the website bidfood.com.au (Website);
(c) purchase from Bidfood two or more cartons of Four N’ Twentty Classic Meat Pies (Product 3018 FNT Classic Meat Pie), in one transaction, in accordance with Bidfood’s standard purchase requirements and terms of business (Qualifying Transaction); and
(d) as part of, and at the time of making the Qualifying Transaction, enter the Promo Code: FOOTY, in accordance with the directions.

7. The entrant acknowledges that the Promoter has no control over the acts or omissions of its employees, subcontractors or any person attempting to enter on their behalf as a representative or authorised representative of the entrant. The entrant will ensure that its authorised representatives comply with these Terms and Conditions, as and when applicable. By entering on behalf of the entrant, the authorised representative, aged 18 years or over, warrants that they have, before entering, obtained permission from the entrant and are authorised to enter the Promotion on behalf of the entrant, and receive any prize on behalf of the entrant, if the prize is awarded to the authorised representative by the Promoter. The Promoter reserves the right to contact the entrant to confirm the individual’s or authorised representative’s compliance with these Terms
and Conditions, including, without limitation, this condition. The Promoter takes no responsibility if the authorised representative or individual has not obtained permission, and may, in its absolute discretion, invalidate that individual or entry made by that individual on behalf of the entrant.

8.
Entrants must retain proof of purchase [original invoice(s)] for verification purposes. Failure to provide proof of purchase in accordance with the Promoter’s request may deem the entrant ineligible and forfeit any right to a prize. The entries awarded may be adjusted by the Promoter, in its absolute discretion, in the case of any returned products.

9. All entries must be received by the Promoter during the Promotional Period. The Promoter: (a) will use the information supplied via the Website that entrants use to submit their entries/claims to conduct the Promotion and contact the winner; and (b) takes no responsibility if the information supplied is inaccurate, incomplete, illegible or indecipherable.

10.
The Promoter reserves the right, at any time, to verify the validity of entries, entrants and prize recipient (including (as applicable) an entrant’s or prize recipient’s identity) and reserves the right, in its sole discretion, to disqualify any individual, entrant or prize recipient whom the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion, or otherwise than in accordance with the spirit of the Promotion. The Promoter may accept errors and omissions in its absolute discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or compensation from such an offender are reserved.

11.
If there is a dispute about the identity of an entrant, individual or prize recipient, the Promoter reserves the right, in its sole discretion, to determine their identity.

12.
The draw will take place at Bidfood’s office at 2 pm on 2/04/26. The winner will be notified by email within 2 NSW business days of the draw. The name of the prize-winning business, or the first initial, surname and postcode (as the case requires) will be published on the Website on 2/04/26 after the draw.

13. The winner must nominate an individual owner, employee, manager or director (aged 18 years or over) to accept the prize (i.e. the prize recipient). The prize recipient agrees they are subject to the same terms and conditions as if they are the winning business. If requested by the Promoter, the winning business, prize recipient, or companion must sign any legal release and indemnity in a form determined by the Promoter. Otherwise, the prize recipient or his/her companion cannot attend the prize.

14. The first valid entry drawn will win the prize of a 2-night trip for two to Melbourne, valued at up to $5,000, depending upon the date, point of departure, for the prize recipient his/her companion (who both must be aged 18 years and over), including:
(a) return economy airfares from the prize recipient’s nearest capital city (or other regional airport that flies direct to Melbourne, as determined by the Promoter in its absolute discretion);
(b) 2-night’s accommodation in a minimum 4-star hotel, as determined by the Promoter in its absolute discretion; and
(c) an invitation for 2 people to attend an event hosted by the Promoter to the value of $500.

The prize is subject to booking and flight availability at all times and may be subject to additional conditions, including, but not limited to, a selected seat class with airlines or specific room category availability with accommodation partners. If the prize recipient (and his/her companion) cannot travel in accordance with these Terms and Conditions, the prize will be forfeited. The prize must be taken on 24/04/26 to 25/04/26, unless otherwise permitted by the Promoter.

Spending money, excess baggage costs, meals and beverages (other than specified), taxes (excluding airport and airline taxes), travel insurance, transport to and from the airport departure point, any additional transfers other than those referred to in the Terms and Conditions, items of a personal nature, in-room charges, vaccinations and all other ancillary costs are not included in the prize. The itinerary is to be determined by the Promoter at its absolute discretion. Frequent flyer points will not form part of the prize. The prize recipient may be required to present their credit card at the time of accommodation check-in as a security measure for any charges incurred during the stay over and above the accommodation cost. The Promoter recommends that the prize recipient and his/her companion obtain travel insurance for their period of travel.

The prize recipient and his/her companion acknowledge that elements of the prize may be subject to additional terms and conditions imposed by third-party prize suppliers, including booking conditions, fare rules, including any amendment fees, baggage restrictions, conditions of carriage, codes of conduct and any standard restrictions or participation conditions in addition to those outlined in these Terms and Conditions. The prize recipient and his/her companion must become acquainted with any such additional terms and conditions before taking the prize. The Promoter does not accept any responsibility and is not liable for any additional conditions imposed by third-party service providers on the taking of the prize or for the breach of those conditions by any person and the consequences that may follow. To the fullest extent permitted by law, the Promoter shall not be responsible for and cannot be held liable for any element of the prize, which is cancelled or delayed, or where the location is changed, or any other occurrence that is out of the reasonable control of the Promoter, or service or prize supplier providers.

15.
The winning business will be contacted by the Promoter and required, within 2 days, to nominate a person, who will be taking the prize (i.e., the prize recipient, who must be the owner or an employee, manager or director of the winning entrant). The Promoter is not responsible for the conduct of the attendees on the trip, who must follow all directions and terms and conditions of the accommodation, service/prize providers, and the Promoter is not responsible should any or all attendees be asked to leave or participate in any part of the prize. The prize recipient and his or her nominated companion must sign a legal release and indemnity in a form determined by the Promoter before they are eligible to take the prize. Failure to do so may result in forfeiture of the prize.

General

16.
The total prize pool value is up to $5,000.

17.
A draw for the unclaimed or unwon prize will be awarded via the unclaimed prize draw. The unclaimed prize draw, if required, will take place at the same place as the original draw on 13/04/2026, subject to any written directions
from a regulatory authority. The winner, if any, will be notified by email within 2 NSW business days of the draw. The name of the winning business, or the first initial, surname and postcode (as the case requires), of the unclaimed prize, if any, will be published on the Website on 13/04/26.

18.
The Promoter’s decision is final, and no correspondence will be entered into.

19.
The prize, including any unused portion, is not transferable or exchangeable and cannot be taken as cash, unless permitted otherwise by the Promoter in its sole discretion.

20.
If the prize is not available, the Promoter reserves the right to exchange the prize (or part thereof) with a prize of equivalent value and specification, subject to any direction from a lottery authority.

21.
Before receiving the prize, the winner and prize recipient must take part in selected promotional activities, including a photograph(s)/video recording(s) at the winning establishment, venue, and interview(s), as reasonably required. Failure to comply with this requirement may result in the winner, the prize recipient forfeiting or participating in the prize. The winner and prize recipient consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same), in any media, for an unlimited period and without remuneration, to promote this Promotion (including any outcome), and promote any products manufactured, distributed and/or supplied by the Promoter. The Promoter will own any intellectual property rights to the materials produced.

22.
If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter (including but not limited to technical difficulties, unauthorised intervention or fraud), the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant or prize recipient; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.

23.
Any cost associated with entering the Promotion or accessing the Website is the entrant’s responsibility.

24.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and Bid Food (including their respective officers, employees and agents) exclude all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.

25.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and Bid Food (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the
Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner, entrant, prize recipient or his/her companion; or (f) the prize.

26.
The Promoter may collect personal information to conduct the Promotion and may, for this purpose, disclose such personal information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on individuals providing their personal information. The Promoter will collect, store, use and disclose personal information as set out in its Privacy Policy, which can be viewed at https://www.pattiesfoodgroup.com/privacy (Privacy Policy). In addition to any use outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning individuals. The Privacy Policy also contains information about how individuals may opt out, access, update or correct their personal information, how individuals may complain about a breach of the Australian Privacy Principles. The Promoter will not disclose personal information overseas. All entries and prize claims become the property of the Promoter.

Conditions of Claim

  1. These Conditions of Claim are to be read in conjunction with the Schedule to Conditions of Claim. To the extent that there is any inconsistency between the Conditions of Claim and the Schedule to Conditions of Claim, the Schedule prevails.
  1. Information on how to submit a claim form part of these terms & conditions. Any claim not complying with these Conditions of Claim and Schedule to Schedule to Conditions of Claim is invalid.
  1. Standard claim restriction: Employees, agents, successors, and assignees of Promoter, its advertising agencies and promotional companies involved in this Promotion, as well as family and household members of same, shall be ineligible to participate in the Promotion and shall be ineligible for any redemption covered herein.
  1. Promotional Period: The Promotion will take place during the Promotional Period. Any claim that occurs outside this period is invalid.
  1. Receipt of electronic claims: Claims are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for incorrect, inaccurate, incomplete, late, lost or misdirected information caused by a claimant or occurring during transmission.
  1. Verification Requirements: The Promoter may require the claimant to provide proof of identity, age, and residency. Where the Promotion requires the purchase of a product(s), the Promoter reserves the absolute discretion to require any claimant to verify every claim they made during the Promotion period in order to claim a reward. If a claim cannot be verified to the Promoter’s satisfaction, the claim will be invalid.
  1. Standard Reward Restriction: All rewards unless stated to the contrary are not transferable & cannot be converted to cash.
  1. Reward Value: Reward value is correct at time of printing but no responsibility is accepted for any variation in the value of any award.
  1. Reward Delivery: Rewards will only be delivered in Australia and each claimant should allow 28 days from receiving your validated confirmation email for delivery of their reward.
  1. Australian Consumer Law: The claimant should look to the manufacturer of products and provider of services for all warranties. These terms and conditions do not exclude or limit the application of any statutory provision (including a provision of the Competition and Consumer Act 2010) where to do so would contravene that statute or cause any part of these terms and conditions to be void.
  1. Tampering: The Promoter reserves the right to disqualify any claimant for tampering with the claim process. Tampering includes but is not limited to the utilisation of techniques designed to avoid payment of call costs or the making of multiple claims that are not associated with a separate eligible purchase, or submitting a claim which is not otherwise in accordance with these Conditions of Claim and Schedule to Conditions of Claim. Should the Promoter find evidence of tampering by an individual, in addition to declaring any or all claims made by that individual invalid, the Promoter may also preclude that claimant from participation future promotions of the Promoter.
  1. Technical Malfunction: If for any reason this Promotion is not capable of running as planned, whether caused by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the Promotion, the Promoter reserves the right in its sole discretion, to cancel, terminate, modify or suspend the Promotion. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person’s handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this Promotion.
  1. Liability: The Promoter is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the reward, except for any liability which cannot be excluded by law.
  1. Disruptive, abusive, unsuitable claims: The Promoter may determine all claims invalid and/or preclude participation by a claimant if they disrupt, annoy, abuse, act contrary to law or engages in fraudulent misleading and deceptive conduct.
  1. Tax: Claimants should obtain their own independent financial advice in relation to any tax liability that may arise as a result of their participation in the Promotion.
  1. Promoters Decisions: All decisions of the Promoter are at their complete discretions and are final. No correspondence will be entered into.
  1. Social Media: The Promotion is in no way sponsored, endorsed or administered by or associated with Facebook, Instagram or Twitter. Claimants completely release Facebook, Instagram or Twitter from any and all liability relating to the Promotion.
  1. Privacy: Each claim becomes the property of the Promoter. All details will be held in accordance with the Bidfood Privacy Policy which can be accessed by visiting https://www.bidfood.com.au/privacy/.
